Springdale Man Sues Subway, Says Footlong Doesn’t Measure Up
A Springdale man has filed a lawsuit against Subway, saying the sandwich giant’s footlong products do not measure up.
Vincent Gotter filed a civil lawsuit against Subway in Washington County Circuit Court on Jan. 25. He claims sandwiches he purchased at a Springdale Subway location were not as long as the six inches and one foot that are advertised, the suit states.
Gotter’s lawsuit will seek damages of more than $5 million, and could reach into the $30 to $40 million range, according to one of Gotter’s attorneys in the case.
“Plaintiff prays that he recover the damages for misrepresentation pursuant to the Arkansas Deceptive Trade Practices Act, measured by the difference in the size of the product as advertised and the product sold,” the suit states.
Gotter’s attorney said the footlong sandwiches are actually 11.5 inches long. He has been working in concert with lawyers from the several other lawsuits around the country concerning the same complaint, he said.
