A Fort Smith man faces a domestic battery charge after police said he shot his son-in-law in the throat because of the way he drove.

Charles Marr, 68, was booked in the Sebastian County Detention Center and has a court date Thursday, officials said. There has not been a bond amount set, according to jail officials.

In a news release, Fort Smith police said they responded to a call at approximately 1:11 p.m. to the 5300 block of Elm Street and found Henry Silas Killian, 62, with a gunshot wound to his neck and lower jaw. The release said officers said Marr told them he had warned Killian, who lives next door with Marr’s daughter, about his driving recklessly and doing doughnuts with his truck in the open lot between the two men’s houses.

The release said Marr told officers Killian did this all the time and it threw mud on his home.

Marr told officers he was getting into the shower when he heard Killian start his truck and begin spinning his tires, the release said. Marr went outside with a 12-gauge shotgun loaded with bird shot and stood by the corner of his house, the release said.

Killian drove toward him and Marr told officers he felt he was going to run him over so he fired a round into the front windshield of the truck, the release said.

After Killian turned the truck around, Marr fired another round through the passenger window that struck Killian, police said. Officers said Killian was transported to Sparks Medical Center with non-life threatening wounds.
