Lawsuit Filed to Repeal Arkansas’ Gay Marriage Ban

Several homosexual couples filed a lawsuit Tuesday (July 2) against the state of Arkansas, according to a report from KTHV in Little Rock.

The suit states Arkansas Amendment 83 denies them the benefits and privileges given to married heterosexual couples.

While the US Supreme Court recognized marriage as one of the ‘basic civil rights of man,’ the Arkansas Constitution prevents gay marriage from being recognized, according to the suit. The plaintiffs in the lawsuit said the amendment is unconstitutional and violates their fundamental rights.

The plaintiffs want a judge to declare the 2004 amendment unconstitutional and to be in violation of the Full Faith and Credit Clause. They also seek an injunction against future enforcement.
