Fayetteville police arrested a drunk homeless man on Tuesday (July 8) after he attempted to walk into traffic when an officer refused to take him to jail, according to a preliminary report.

Daniel Owens, 26, walked up to an officer during a traffic stop on Tuesday evening. Owens then asked the officer to take him to jail for public intoxication, the report states.

The officer refused on the grounds that the man, “was not a danger to himself or a public nuisance,” according to the report.

The officer noted in the report that a strong odor of intoxicants was coming from the homeless man’s breath. The intoxicated man also had poor balance and slurred speech, the report states.

Owens then walked out into traffic, and a vehicle had to stop to prevent from hitting him, according to the report.

He was placed under arrest and booked into the Washington County Detention Center. Owens faces charges of public intoxication and disorderly conduct, the report states.

He is being held on a $435 bond, according to the jail’s intake report.
