WASHINGTON COUNTY (KFSM) – Prosecutors will not file charges against a fired Washington County deputy accused of performing a sex act on a man without his consent, according to the Washington County Prosecutor’s Office.
Hayden Colt Miller, 23, was arrested in May on suspicion of rape after an alleged victim told the Sheriff’s Office of an incident that occurred several months ago where the victim awoke to find Miller performing a sex act on him without his consent, according to a statement released by the Sheriff’s Office.
Deputy prosecutor Matt Durrett said the case is closed at the request of the victim. The victim decided he wanted to move on from the situation and did not want to drag it out, Durrett said.
Miller was fired from the Sheriff’s Office shortly after his arrest. He worked for several years as a dispatcher and was assigned to the patrol division in July 2012, according to the Sheriff’s Office statement.
The alleged rape occurred at Miller’s home, which is in Fayetteville. The Fayetteville Police Department was notified and immediately started an investigation. Miller was interviewed, and he confessed to performing the act, according to the Sheriff’s Office statement.
He gave no explanation for doing what he did and stated that what took place was rape. He was arrested by Fayetteville detectives after the interview, according to the statement.
A second Washington County deputy was arrested that same month, as detention officer Dalton Shepherd faced charges of assault on a family member, endangering a child and harassment.
The arrest came after Shepherd’s girlfriend called police dispatchers, saying that Shepherd was following her and trying to run her off the road and had her blocked in. She informed dispatch that she had her one-year-old child in the vehicle with her, according to court documents.
Shepherd resigned from his Sheriff’s Office position shortly after his arrest.
Court documents state Shepherd followed his girlfriend on Interstate 49 traveling at speeds in excess of 85 miles per hour.
Shepherd has a misdemeanor court date set in West Fork District Court for Aug. 26, prosecutors said. No felony charges were filed against him.
