FORT SMITH (KFSM) – Authorities said a man is being held without bond at the Sebastian County Detention Center Wednesday (Sept. 3) after being arrested in his underwear while refusing to leave a Fort Smith gas station.

Josh Spence, 23, from Pocola was arrested for disorderly conduct early Tuesday morning (Sept. 2) at the EZ Mart on Highway 271. The store clerk called police after he said Spence came into the store, stripped down to his underwear and wouldn’t leave. Once officers arrived on scene, they said it appeared that Spence high on drugs. He told officers that his entire family had been killed at that time, authorities said.

Pocola Police said they did a welfare check on Spence’s family after he made the allegations, and confirmed that no one had been hurt.

5NEWS did talk with Spence’s mother after his arrest as well. She said he does have a history of mental illness.

Authorities said Spence is being required to undergo a mental evaluation by the state, before he is eligible to be  released on bond from the detention center.

His first court appearance is set for Thursday afternoon (Sept. 4), according to authorities.
