SPRINGDALE (KFSM) – A Springdale man was arrested on suspicion of raping a 13-year-old girl, according to court documents.

Juan C. Martinez, 19, was booked into the Washington County Detention Center on Friday (Sept. 5) at 1:29 a.m. He faces charges of rape, contributing to delinquency of a juvenile and obstructing governmental operations, and his bond has been set at $25,000, according to the jail’s intake report.

On Sept. 1, Springdale police were flagged down in the Brookhaven Apartments at 2788 Crooked Creek Circle in Springdale by a mother looking for her daughter, court documents state.

She said that her daughter, the 13-year-old victim, may have been in an apartment with a male later identified as Martinez, according to court documents.

Officers knocked on his door and asked if he’d seen the victim. He said he did not know anyone by the victim’s name, court documents state.

Martinez gave officers permission to search his apartment, and they found the victim hiding in his closet, trying to fix her clothes as if she was in a hurry, according to court documents.

The victim was returned to her mother, court documents state.

On Sept. 3, the victim was interviewed by authorities, and she said she had sex twice with Martinez. She started when she was 12, according to court documents.

On Sept. 4, police interviewed Martinez, and he said he had sex with the victim twice and was in love with her, court documents state. He also said he asked her both times before they had sex if she wanted to do it, and she consented, court documents state.

In Arkansas, individuals under 14 years of age cannot consent to sexual activities with adults, according to the U.S. Department of Health and Human Services.

Martinez was arrested after the interview, and his first hearing is scheduled for Sept. 8, according to the jail’s intake report.
