GREENWOOD (KFSM) – The Arkansas Supreme Court denied a request for an expedited review of the Shadow Lake annexation case on Thursday (Oct. 23), according to court documents.

On Oct. 8, Sebastian County Judge Michael Fitzhugh struck down ordinances from the Nov. 4 ballot made to annex the Shadow Lake community into Greenwood, saying there were Arkansas Freedom of Information Act (FOIA) violations in the way the ordinances were handled with the Greenwood City Council and Greenwood city attorney, according to court documents.

The way the ordinances were created violated the Open Meetings provision of FOIA, court documents state.

Those ordinances struck from the ballot concerned the annexation of the Shadow Lake community, along with seven other land tracts, into Greenwood.

After Fitzhugh made his ruling, the case was appealed to the Arkansas Supreme Court, and a motion was filed to expedite the appeal.

That motion was denied by the court on Thursday, but a final ruling has not yet been made on the annexation case, court documents state.
