BENTONVILLE (KFSM) – Two men were arrested on Tuesday (April 14) in an embezzlement case involving the Bentonville American Legion, police say.

Marvin D. Akers, 51, of Rogers and Kim R. Emerson, 60, of Farmington were both booked into the Benton County Jail on Tuesday and face a charge of theft of property-embezzlement, detention center records state.

On March 10, police were told about a possible theft that took place in September 2009 involving funds that were received after the Bentonville American Legion building was sold, according to a news release.

Two of the legion’s members received a large sum of money two days after the building was sold, police said.

“Further investigation revealed these same two members conducted numerous other transactions involving the legion’s funds that totaled over $133,000,” the release states.

On April 13, an arrest warrant was issued for the two suspects, and they were later taken into custody, according to police.

Emerson is a former treasurer of the Bentonville American Legion, the release states.

The next court date for both has been scheduled for May 26, according to jail records.
