FAYETTEVILLE (KFSM) – A Fayetteville man was arrested Friday (May 22) after police said he threw a puppy over a guard rail at his apartment.

Fayetteville Police and Animal Control Officers were dispatched to 1235 W. Mount Comfort Apt. 304 in reference to a complaint about a possible animal cruelty case. Police said they were informed that resident Josh Woodruff had possibly killed a puppy at his home by intentionally kicking it off the third story balcony.

Upon arrival, police said Woodruff confirmed that there was a six week old puppy at his home that died the day before on Thursday, (May 21) at 2PM. Woodruff initially told officers that the puppy had fallen off the ledge while being outside. However, he eventually confessed that he got upset at the puppy for using the restroom inside his apartment. Police said Woodruff told officers he let the puppy outside and as it walked along the balcony edge he kicked it, causing the dog to fall on the sidewalk. Woodruff said the puppy died immediately upon hitting the ground.

After retrieving the puppy, the man told police he threw it in the woods on the south side of his apartment building. Police said Woodruff tried to bury the puppy with his pocket knife but left parts of the puppy exposed. Fayetteville Animal Control was able to find the puppy and took it in for evidence purposes. Once the puppy was discovered, Animal Control said the puppy had been decapitated. Woodruff denied any knowledge of knowing what happened to the head.

Woodruff was arrested and taken to the Washington County Sheriff’s Office. Following his arrest, Woodruff confessed in a interview  that he had actually picked up the puppy and thrown it over the guard rail.

Woodruff faces charges of Aggravated Animal Cruelty. His next court date is set for May 27th.
