FORT SMITH (KFSM) — A judge dismissed a Freedom of Information Act lawsuit filed against the Fort Smith School Board after it voted to change Southside High School’s “Dixie” fight song and Rebel mascot.

Judge James Cox rejected the FOIA case Thursday (Oct. 1), according to the Sebastian County Circuit Clerk. Joey McCutchen filed the lawsuit claiming the school board violated FOIA laws by not giving the public enough notice about their plans for a vote.

McCutchen said that he plans to appeal the judge’s decision.
