SEQUOYAH COUNTY (KFSM)– A man set to stand trial for a conspiracy charge in the case involving a teenager who was severely injured in an ATV crash in 2013, was arrested over the weekend for public intoxication.

A deputy arrested Kyle Brannon, 21, around 7 p.m. Saturday (June 25), according to Sequoyah County Sheriff Ron Lockhart. It happened in the Belfonte area, which is north of Roland. The sheriff said Brannon was standing outside his pickup getting a beer out of an ice chest on a county road with his eight-month-old child in the vehicle, Lockhart said. The deputy never saw Brannon driving, but said he was intoxicated, according to the sheriff. The infant was released to a relative, Lockhart said.

Following a preliminary hearing last month, Brannon, Angela Gray and her son Joey Gray were charged with conspiracy in the ATV crash, which left Christian Mayberry, who was 17 at the time, with severe brain damage. A judge ordered a trial for for all three of them.

Gray faced a jury in 2015, but it ended in a mistrial after jurors couldn’t reach a unanimous agreement on who was driving the ATV that night.

Records show Angela Gray left Mayberry in a ditch while Brannon and another teen poured beer on Christian’s face.

The prosecution has said they plan to prove to a jury Angela Gray was driving the ATV while intoxicated and her son and Brannon tried to take blame for the crash.

Records show Brannon turned 21 on June 11.
