CAVE SPRINGS (KFSM) — The former Cave Springs police chief, who was fired in August after he was accused of issuing unauthorized Benton County Deputy Sheriff commissions will not face criminal charges, according to Benton County Prosecutor Nathan Smith.

Smith stated there was insufficient evidence to support a felony charge of tampering with a public record.

The prosecutor pointed out it is undisputed that officers who were not intended to be commissioned by the sheriff were commissioned using duplicated commissioning forms, but the evidence does not point to a crime because there appeared to be confusion in the police department as to who would receive a commission and the investigation was unable to determine who made unauthorized copies of the commission forms.
