Two Rogers men were arrested on battery and drug charges after a shooting incident that left them and another man injured.
Erik Yanez, 22, is charged with battery, manufacturing a controlled substance, possession of drug paraphernalia and possession of a controlled substance, according to a police report.
Nicholas Watson, 22, was arrested and charged with possession of a controlled substance and possession of drug paraphernalia.
The shooting happened at a residence on W. Sunset Street on Memorial Day.
Yanez, Watson and David Grajeda were in a ‘small circle with their heads near each other’ when Yanez dry fired a .357 revolver with one chambered round under Grajeda’s chin, according to a police report.
"It's a revolver, so when you pull the trigger the first time and nothing happens it is because it did not hit on the chamber with a bullet, that's a dry fire," said Rogers Public Information Officer, Keith Foster. "So then when you go to pull the trigger again, the cylinder rotates, there was a bullet in that one and it fired."
As Yanez fired a second time, Grajeda tilted his head, police say. The gun fired causing all three of them to sustain head injuries. None of their injuries were life-threatening and they sought treatment at local hospitals, according to police.
Keith Foster with Rogers Police says there was no indication that the three men were fighting or upset with each other prior to the incident.
"I think it's probably more just goofing off," said Officer Foster. "From all indications, they are all friends, they may actually live there in the house together. There's no indication that they were angry or mad at each other. Any kind of incident like that before the shooting."
Yanez is being held at the Benton County Sheriff’s Office pending a bond hearing.
Officers seized a marijuana grow operation and the gun used in the shooting at the residence.
"While they were searching they found several marijuana plants in various stages of growth in the garage, they also found marijuana plants in various stages growing in another bedroom also," said Officer Foster. "Drug paraphernellia and different items like that in the kitchen."
The investigation is ongoing.
