Attorney Patrick Flake entered a not guilty plea for his client, Thomas Harold Morgan, 47, also known as “Sondance the Clown,” Thursday morning.
Flake also waived a formal arraignment. Morgan is facing four counts of possessing material depicting sexually explicit conduct with a child.
Last month a Sebastian County circuit judge set bond at $100,000 for Morgan. He was also ordered through conditions of his bond to avoid having contact with children under the age of 18 and he was also banned from using the Internet.
However, a court administrator says Morgan has refused to sign the document.
According to Fort Smith Police, a forensic team detected someone was downloading pornographic materials involving children though a well-known internet file-sharing network. Morgan was at his residence in the 500 block of S. 20th on June 20.
After investigators obtained a search warrant for Morgan’s residence police say several items of digital media were seized. Police do not believe Morgan was uploading any images, and say so far they have not had any victims come forward with allegations about Morgan.
According to Morgan’s website, he performs at parties and events in the area. He claims his educational background is in childhood development.
