Tim Hollis, the Fayetteville high school teacher banned from campus until he completes an anger management class, filed a court document Monday asking the court to deny a motion by the school district to dismiss his lawsuit.

In the document filed in Washington County Circuit Court, Rogers attorney Ken Swindles states Superintendent Vickie Thomas and the district “does not have the discretion to order counseling or ban a teacher from school until such counseling is completed” and requests that the court dismiss the district’s motion to dismiss.

Attorney Christopher Heller filed the motion requesting the court dismiss Hollis’ lawsuit on June 29. In the motion, Heller states Hollis is attempting to avoid the school district’s disciplinary process by filing a lawsuit.

In May, Swindle filed a lawsuit on Hollis’ behalf against the school district claiming a breach of contract after Thomas asked him to take an anger management class. In addition to breach of contract, the lawsuit claims Thomas and the school violated the public school employee fair hearing act and their actions were a breach of personnel committee policy and breach of teacher fair dismissal act.

Hollis is a forensics and debate coach at Fayetteville High School.
