Prairie Grove resident Eugene McCarty, 72, was found guilty by a Washington County Circuit Court jury on Thursday (Dec. 20) of raping, kidnapping and sexually assaulting a 9-year-old Oklahoma girl, court records show.

McCarty was sentenced to 35 years in the state Department of Correction and fined $5,000, records show. He was given 25 years on the rape charge, 10 years on the kidnapping charge and 10 years on the second-degree sexual assault charge. He will serve the two 10-year charges concurrently, prosecutors said.

According to court testimony, McCarty was helping the girl's mother move from their Westville, Okla., home on July 3, 2012, and said he was taking the girl to a nearby Dollar General store to get some boxes. However, he instead took the girl to his home across the state line in Prairie Grove and kept her there overnight, engaging in sexual acts, prosecutors said.

The girl's mother arrived at McCarty's home on July 4. She walked in the back door and saw the two engaged in a sex act, according to court testimony.

The mother did not report the incident to authorities, instead later telling her brother, who phoned police, according to prosecutors.

The mother later was imprisoned for permitting the abuse of a minor, failing to take action and failing to notify police, prosecutors said.

Attorneys for both sides wrapped up the two-day trial with closing arguments Thursday at about 12:30 p.m., and the jury returned the verdict about four hours later.

Judge William Storey handed down the sentence Thursday afternoon.
