A LeFlore County man shot during a domestic dispute on Super Bowl Sunday does not want to press charges against his stepson who allegedly shot him, according to the sheriff.

Deputies interviewed Robert Gene Hamner, 35, who is recovering from three gunshot wounds at a Tulsa hospital about the incident on Feb. 3.

Neither Hammer, or his wife Jamie Lovell, 40, who Hammer is accused of assaulting that night, want to press charges in the incident, Sheriff Rob Seale said Wednesday.

According to Seale, the LeFlore County District Attorney is still reviewing the evidence collected at the scene of the shooting on Pleasant Valley Road and will decide whether to press charges in the either the assault or the shooting.

Deputies responded Hamner’s residence of Poteau late Sunday night, after the Super Bowl ended.

“There was some alcohol involved in the incident, and it just kind of escalated out of control from there,” Seale said. “It’s just a freak thing. Somebody gets mad over a football game and it escalates into a bad domestic episode.”

Investigators believe Hamner was unhappy with the outcome of the game and began fighting with his wife. Lovell’s 21-year-old son, Caleb White, fired four shots from a .40 caliber handgun at Hamner, three of which struck him in the abdomen.

All involved were questioned about the incident but no one was arrested.

The Baltimore Ravens beat the San Francisco 49ers, 34-31.
