Prosecutors in Oklahoma will seek the death penalty in the first degree murder and forcible sodomy trial of one of the brothers accused of killing a Fort Smith woman in 2010.

Johnathen Thacker, 24, pleaded not guilty in a LeFlore County district court Wednesday (March 13). His trial date has been set for Jan. 14, 2014, according to the court clerk.

Thacker’s brother, Elvis, who faces the same charge, is awaiting a competency hearing. A mental evaluation is underway, according to officials.

The Thacker brothers  are accused of killing 22-year-old Brianna Ault. Her body was found in a pond near Pocola on Sept. 13, 2010. Her throat had been slashed, according to police reports.

Prosecutors Seek Death Penalty in Thacker Trial

The Thackers are already serving time in Arkansas after pleading guilty to unrelated rape and kidnapping charges, as well as, attempted capital murder of a Fort Smith Police officer.
