FAYETTEVILLE (KFSM) – An intoxicated Fayetteville man was arrested on Tuesday (Sept. 16) on suspicion of crashing his scooter while his daughter rode with him, police say.
Michael McElroy, 44, was booked into the Washington County Detention Center on Sept. 16 at 1:32 a.m. on suspicion of driving while intoxicated (police believe the intoxication was drug related), careless driving and driving on a suspended or revoked license, according to the jail’s intake report. His bond was set at $2,000, and he was released from jail on the same day at 11:49 a.m., the jail’s intake report states.
On Monday (Sept. 15) at 8:35 p.m., police came to the area of West Persimmon Street and North Mountain Ranch Road responding to a call about a scooter accident that involved injuries, according to court documents.
When police arrived, they talked to McElroy and saw his scooter was in a nearby ditch, court documents state.
His daughter was treated and transported to a nearby hospital with unknown injuries, according to court documents.
Police noted in the documents that McElroy appeared heavily impaired with an odor of intoxicants, bloodshot eyes, slurred speech and an unsteady balance, court documents state.
He performed poorly in standard police field sobriety tests and admitted to drinking, according to court documents.
He was arrested on suspicion of DWI and taken to the Washington County Detention Center for further investigation. Records showed that McElroy had a previous DWI arrest on his record from 2013.
McElroy took a breath test and had a blood alcohol content of .045 percent, court documents state. The blood alcohol limit in Arkansas is .08 percent for drivers above the age of 21, according to the Arkansas Department of Motor Vehicles.
Due to McElroy’s impairment, a urine test was requested by police. McElroy agreed to submit to a urine test, but he refused a drug recognition expert evaluation. A urine sample was collected, and McElroy was booked into the detention center, according to court documents.
His next court date has been scheduled for Oct. 13, according to the jail’s intake report.
