OKLAHOMA (KFSM) – Oklahoma State Bureau of Investigation is investigating the death of man after he dies in police custody.

A Warner police officer responded to a traffic accident just after 1 a.m. Saturday (April 4), in the area of Highway 64 and 158th Street South, according to OSBI.

According to police, the driver identified as 33-year-old David Cody Lynch assaulted the officer. The officer then tased Lynch and handcuffed him.  After making the arrest, the officer noticed the man was not moving or breathing, according to police.

Lynch was then transported to a local hospital where doctors pronounced him dead.

The Muskogee County Sheriff’s Office requested OSBI agents investigate the death.  At the conclusion of the investigation, an agent will deliver a report to the district attorney. The district attorney will then determine if there was any wrong doing on the part of the officer.

Lynch’s body has been sent to a medical examiner for autopsy.
