LITTLE ROCK (KFSM)- A Little Rock law firm has filed a class action lawsuit against the four organizers that were supposed to put on the now-canceled Thunder on the Mountain music festival on Mulberry Mountain in Ozark.
The lawsuit against Pipeline Productions, Inc., Backwood Enterprises, LLC, Madison Companies, LLC and Horsepower Entertainment, LCC was filed on June 22 by Grant Williams and on behalf of other customers who purchased tickets to the festival.
Thunder on the Mountain was supposed to take place from June 26 to 28, but the festival was cancelled on June 13.
According to the class action lawsuit, the four companies involved in organizing the event violated the Arkansas Deceptive Trade Practices Act. The suit claims the defendants hid “the considerable tension between them related to funding the festival, and indeed, that the funding of the festival was on very shaky ground.”
Instead of revealing the issues to the public, the organizers continued to sell tickets to Thunder on the Mountain even though they knew the festival was likely to be canceled, according to the lawsuit. Aside from purchasing tickets to the festival, customers also made hotel and camping reservations and other accommodation plans and therefore “incurred substantial and actual damages due to Defendants’ deceptive, unfair, and unconscionable actions,” the lawsuit states.
Separate lawsuits filed in federal courts by Pipeline Productions/Backwood Enterprises and Madison Companies/Horsepower Entertainment against each other, claim there were financial disagreements between the parties.
The class action lawsuit is seeking that the plaintiffs in the case be compensated for their actual damages.
