SALLISAW (KFSM) — Jurors declared a mistrial after stating there was not enough evidence to determine whether or not Angela Gray was guilty of leaving the scene of an accident involving Christian Mayberry.

Prosecutor Michael Ashworth said he will seek a retrial.

The jurors deliberated for more than eight hours Thursday (August 20). District Judge Jeff Payton read notes from the jury out loud in the courtroom. One note stated, “We are not going to agree!” according to Payton.

One juror said the main issue was determining who was driving the ATV in the accident that injured Mayberry.

Jurors did reach a verdict of not guilty on the second charge against Gray: contributing to the delinquency of a minor.

Mayberry’s mother, Kim, said the next step for her son is to receive treatment in a 10-day-program at Carrick Brain Center near Dallas.
