BENTONVILLE (KFSM) — A Bentonville man was arrested after allegedly using his phone to record inside the bathroom at a dance studio on Wednesday (Dec. 9).

Matthew Shelby, 39, is facing felony charges of video voyeurism, tampering with physical evidence and possession of a controlled substance, according to a press release.

A man walked into the men’s restroom at Infinity Dance and found a cell phone that fell down near the sink, according to a probable cause statement. The phone was actively recording.

The man picked it up and stopped the recording, then viewed the nearly two-minute video, which showed a man’s face, the document states. The man said that it was obvious that the phone was being positioned so that it pointed toward a bench in the restroom.

According to the report, there are two bathrooms at the business, one male, one female. Children commonly use the bathrooms to change clothes.

The man had the phone in his hand as he was leaving the restroom and was approached by Shelby, who claimed the phone and took it from the man’s hand, the document states. The man identified Shelby, who is not an employee of the business, as the same man in the video.

Shelby was held in the Benton County Jail on a $20,000 bond.
