FORSYTH, Ga. (WXIN) – A Georgia county is being sued for wrongful arrest by a woman who was jailed when her cotton candy falsely tested positive for methamphetamine.
Dasha Marie Fincher tells WMAZ-TV she was arrested in 2016 when a deputy pulled over and searched the car she was riding in.
A Monroe County Sheriff’s Office report says the candy’s “packaging and crystal like feature” prompted deputies to use a field kit to test the candy for methamphetamines and MDMA. It came back positive.
The report says Fincher and driver David Maynard Morris, Jr. both had suspended licenses and were arrested. Fincher says she was jailed until a state crime lab in 2017 found no controlled substances in the candy.
The November lawsuit names the county, deputies and drug kit manufacturer as defendants.
