Rogers woman jailed after her 2-year-old tests positive for THC

Presley Lynn Harris was arrested after her two-year-old child tested positive for THC and was hospitalized.

ROGERS, Ark — A Rogers woman has been arrested after her two-year-old son was hospitalized and tested positive for THC. 

Presley Lynn Harris, 32, was arrested on Jan. 18 and is accused of endangering the welfare of a minor in the first and second degree.

According to an affidavit, the Rogers Police Department (RPD) received a report on Jan. 8 that the child was transported to Mercy Hospital for being lethargic, somnolent and having strange behavior a few days prior. 

Investigators found that the child was later transported to a children's hospital in Little Rock.

RPD spoke with a social worker in Little Rock who advised that the child was admitted into the infant trauma unit at the hospital and tested positive for THC. The child reportedly had a seizure, was intubated, and placed on a ventilator due to breathing issues, court documents said.

The social worker told police that the child's mother, Harris, told doctors that she kept her THC gummies on top of her refrigerator and was unsure how the child got to them, according to court documents. 

Police went to Harris' residence on Jan. 11 and spoke with her, the affidavit said. She said that on Jan. 6, she was in the living room with her three children and had just taken a small bite of her "Top Shelf Delat 9/Delta 8" gummy containing THC. 

The affidavit said Harris told police that when she bit the gummy, the two-year-old wanted some thinking that it was candy, and she explained that it was not. Harris said that when she woke up from a nap, the child was asleep before waking up crying, arching his back and unable to open his eyes all the way. 

Court documents say that Harris was unaware he had gotten ahold of the gummy until he tested positive for THC at the hospital. Harris told police that she believes the child climbed on the counter, reached on top of the refrigerator, and got the gummy. 

Police advised that Harris' six-year-old and four-year-old had easier access to where she put the gummy, and she said that she "made a mistake and learned her lesson and realized now they would be able to reach it," the affidavit said. 

Harris made her $20,000 bond and was released on Jan. 20. She has a court appearance on Feb. 26 in Benton County.
