Can you get arrested under Arkansas law for not wearing a life jacket?

Although it is preached year after year, people continue not to wear their life jackets. But can you be arrested if you're caught by authorities not wearing one?

LITTLE ROCK, Ark. — We are days away from the unofficial start of Summer, and on Memorial Day weekend the lakes and rivers of the Natural State will be filled with boaters.

“You want to make sure to inspect your life jackets before you head out. No tears or holes. Also, make sure they fit properly" explained Erin Jimenez, a public affairs specialist with the U.S. Army Corps of Engineers Little Rock Division. 

She added that this is the time of year when folks need those safety reminders before they get out on the water.

“Make sure you’re wearing the correct lifejacket for the right activity. Whether you’re fishing, boating, wakeboarding, and things like that. Don’t overestimate your swimming ability," she advised.

Although it is preached year after year, people continue not to wear their life jackets. But will you be arrested if you’re caught by authorities not wearing it?

“So, federal law requires there is a coast guard approved life jacket for each person onboard that vessel, and Arkansas state law says children 12 years and younger are required to wear a life jacket," Jiminez described. "So while it’s not illegal for an adult not to wear a life jacket, we do not recommend that. Accidents can happen at any time, so we always recommend wearing a life jacket while on or near water.”

So while you won’t be arrested if you’re caught without a life jacket, Jimenez still highly recommends them. 

“It’s definitely worth it. Yes, they aren’t fashionable, but for me, it’s worth it for peace of mind with me and my family that we’re safe," she said.

The U.S. Army Corps of Engineers also recommended downloading their app if you have any additional questions about life jackets or water safety.
