City of Tontitown and mayor file appeal on Eco-Vista Landfill expansion ruling

In the filing, attorneys for the city argue that Commissioner Melton failed to follow commission rules and due process.

TONTITOWN, Ark. — Mayor Angela Russell and the City of Tontitown have filed an appeal on a ruling for plans to expand the Eco-Vista Landfill.

Residents who live near the landfill strongly oppose the expansion, but Waste Management representatives say the landfill is running out of space. 

The paperwork was filed on July 26, 2024, in Washington County Circuit Court. It challenges the decision of the Arkansas Pollution Control and Ecology Commission (APCEC). 

In the filing, attorneys for the city argue that Commissioner Melton failed to follow commission rules and due process and that attorneys for Eco-Vista did not follow APCEC rules. 

The City is asking the court to order a new vote on the case in compliance with the rules and due process.
