Fayetteville reports 'increase in complaints' regarding violation of city's Garbage Cart Ordinance

FAYETTEVILLE, Ark — The City of Fayetteville released a reminder this week about the Garbage Cart Ordinance after an increase of violation complaints. 

The Garbage Cart Ordinance, or City Ordinance 50.20B(2), requires that residential customers of the city's Recycling and Trash Collection (RTC) Division removed their garbage carts or recycling containers within 12 hours after the scheduled pickup time.

The city says that pick-up is anytime between 5 a.m. and 3 p.m. unless otherwise specified by RTC.

“We are offering a friendly reminder to our community members who may not be aware that leaving out the trash cart and/or recycling container for too long is a violation of City Code,” Environmental Director Peter Nierengarten said.

The city says that the reminder comes after an increase in complaints of residents not removing their garbage carts within the time constraints of the ordinance. 

An excerpt from the ordinance can be found here: "Residential garbage carts shall be placed at a single collection point within 6 feet of the curb, street or alley line, where applicable, by 5:00 a.m. on mornings regularly scheduled for garbage and trash collection, provided however, that garbage carts shall be removed within twelve (12) hours thereafter. Alternate collection points may be specified at the discretion of the city.”
