Lawsuit: Fayetteville apartments sue nearby homeowners for housing unsheltered people

FAYETTEVILLE, Ark. — According to court documents, the owner of a Fayetteville apartment complex has filed a lawsuit against a nearby couple who regularly take in unhoused people with substance abuse issues.

SZ Fayetteville Apartments LLC, the owners of the "Alight Fayetteville" complex on S School Avenue, are suing Richard and Gladys Tiffany for reportedly allowing people experiencing substance abuse issues to stay on their property, against the city's regulations.

According to the lawsuit, for at least five years, the Tiffanys have allowed many homeless people in need to stay in and around their home, going so far as to request a permit from the city to operate a campsite, which was denied.

"Both the campsite and the [Tiffanys] building are unsuitable for the purposes to which the [Tiffanys] put them," the lawsuit says.

The lawsuit goes on to list multiple different instances between May 2022 - August 2024 where people staying on the Tiffany property allegedly committed several crimes after crossing over to Alight Fayetteville property.

The alleged crimes include trespassing, theft, harassment, and attempted assault.

SZ Fayetteville Apartments LLC is asking the courts to bar the Tiffanys from hosting or allowing unrelated people on their property. If that fails, the LLC is also seeking compensation for any property damage or extra security they may need to hire, as a result of the Tiffany family's alleged visitors.

On April 2, the Fayetteville City Council voted unanimously to declare a housing crisis in the city. 

5NEWS reached out to the Tiffanys and lawyers representing SZ Fayetteville Apartments LLC, and we haven't received a response to our questions.
