SEBASTIAN COUNTY, Ark. — A Greenwood City Council member was booked into the Sebastian County Jail and faces a driving while intoxicated charge, according to booking records.
Tim Terry, 50, was arrested by the Sebastian County Sheriff's Office on Sept. 14. Records said he was booked at 3:53 a.m. and released around 8 a.m. on a $1,000 bond.
In the arrest report, the officer said he noticed a vehicle turning onto West Center Street from Highway 71 cross over the center line at around 2 a.m. The same vehicle then reportedly crossed over the fog line.
The officer said he initiated a traffic stop and tried to get the vehicle to pull over at a gas station on W. Center Street, however, the driver passed "multiple pull-offs that would have provided a safer stop location" and stopped on the side of the street.
The officer said in the report that the car and driver smelled of alcohol. Terry told the officer that he and his wife were at the casino and that his wife had been drinking, but the officer noted the "odor of intoxicants became stronger" when Terry would turn to look at him.
Terry was asked to step out of his vehicle and perform a few field sobriety tests, all of which he failed according to the officer's report of the arrest. The officer said he asked Terry how much he had to drink. "Mr. Terry stated he had a drink at the casino and claimed it was a while ago, but he did not elaborate further," the report says.
According to the report, Terry was arrested based on failing the sobriety tests, smelling like alcohol, his manner of driving, and admission of drinking. The officer said that it was "apparent" that the alderman "was under the influence of alcohol to a point where it was not safe to drive."
The report says that Terry refused to take a Blood-Alcohol Content (BAC) test. He was arrested for DWI and refused to submit to a chemical test.
Shortly after the arrest, Terry took to his X account to talk about it. Terry advised his followers to not drink and drive. According to Terry, the "traffic stop was bogus."
Terry appeared in the Greenwood District Court on Sept. 16. Terry told 5NEWS he pleaded not guilty. He did not provide any additional comments.
Terry serves as an elected alderman representing Ward 2 on the Greenwood City Council.
5NEWS reached out to Greenwood Mayor Doug Kinslow for comment. He said he preferred to not make a statement at this time.
