BENTONVILLE (KFSM) -- One person is recovering from a gunshot wound after the Bentonville Police Department responded to a shooting near SW Regional Airport Boulevard and SW "I" Street Saturday (Oct. 28) afternoon.
Police said the shooting took place inside a moving car following an altercation. Five people were in the vehicle.
Two juvenile male suspects ran from the scene. One of the boys was arrested nearby. The other suspect, identified as the shooter, was at a home in Centerton, and police there took him into custody.
Police said a victim was treated at a local hospital for a gunshot wound and released.
The gun was recovered and an investigation is underway, according to police.
Benton County Prosecutor Nathan Smith said they make decisions as to how to charge them once they have all the evidence and review it.
He said when it comes to the decision of whether to charge them as adults the default position of the law is that every juvenile will be treated as a juvenile unless the state can allege and prove certain things that would justify charging them as an adult.
Smith said it's too early in this case to know.
"We have done it before in the past, charge juveniles as adults but that really depends on the severity of the crime as well as the age of the offender and their relatively responsibility criminally in whatever incidents they`ve been arrested for," Smith said.
